Real estate instead of alimony: parents have been advised a legal way.


According to the Family Code of Ukraine, parents must support their child until they reach adulthood. If a father does not live with the child, he must pay alimony. However, there is an alternative way to fulfill this obligation.
Lawyers from 'Free Legal Aid' explained that the alimony payer can transfer real estate instead of paying alimony. He can transfer a plot of land, an apartment, a residential house, or other real estate to the child's ownership or to the parent with whom the child lives.
To take advantage of this opportunity, one must first contact the guardianship authority with the necessary documents regarding the property and identification. After obtaining permission from this authority, it is necessary to contact a notary to conclude the appropriate agreement. It is important to note that if the child is already 14 years old, they must participate directly in the conclusion of such an agreement.
'After the contract is concluded, the parent with whom the child lives undertakes to independently support the child,' the lawyers explain.
The property that is transferred can belong directly to the child or be jointly owned by the child and the parent with whom they reside.
Regarding the possibility of selling such property, the lawyers note that this is possible, but until the child reaches adulthood, it can only be done with the permission of the guardianship authority. After 18 years, the child can independently dispose of this property based on ownership rights.
